Terms of sales

Article 1: Acceptance of the General Terms of Sale

The fact of filling a purchase order on www.leos-creations.com and confirming this order stands for full acceptance of these general terms of sale.

Article 2: Conclusion of the sale contract

The sale is concluded according to French laws pertaining to long distance selling, as soon as the purchase order is validated. The system of automatic recording of the purchase order is regarded as proof of the nature of the agreement and its date.

As soon as the order is received, and after validation of the payment, the order is deemed accepted by Léos Créations®. Léos Créations® then sends to the purchaser a confirmation by e-mail, indicating the selling price and the transport charges. In the same manner, Léos Créations® notifies the customer by e-mail in the event of refusal of acceptance of an order.

Article 3: General obligations of the parties

3.1 Obligations of Léos Créations®

3.11 Handling of the orders
Léos Créations® pledges in the event of an acceptance of an order, to sell and deliver to the customer the ordered items.
For some orders, an additional time might be necessary. The customer will be notified and will keep all liberty to confirm, modify or cancel the order.

3.12 Availability
The items presented on the www.leos-creations.com site are normally available and the site is updated after each sale.

If for any reason, an item considered available could not be delivered to the customer, the paid amount would be completely refunded to him, without him being able to claim any compensation.

3.13 Product information
Due to the nature of some of the raw material (wood) the samples presented are given only as an indication. Those, as the photographies illustrating the products, are not deemed contractual.

3.2 Obligations of the purchaser
In addition to the payment of his order, the purchaser must provide the necessary information to the delivery and in particular an address to which the delivery can be made during business hours.

Article 4: Price, invoice

4.1 Price
The total price indicated in the confirmation of order by Léos Créations® is the final price. This price includes the cost of the items, the packaging costs and the shipping costs.
For France, the prices are all inclusive of tax.
For the countries of the European Union, the Value Added Tax (VAT) is included in the price of the products, in agreement with the European accords. No custom duty and no additional VAT will be charged.
For the rest of the world, the VAT and other custom duties and shipping costs can be added to the price indicated on www.leos-creations.com and remain the responsibility of the recipient.

4.2 Invoice
An invoice is provided for each order.

4.3 Terms of payment
Payment can be made online, by check or credit card (Visa, Mastercard).
The online payment by credit card is secure and insured by the banking establishment Crédit Agricole recognized for its reliability in regards to internet transactions. The transaction between customer and the servers of Credit Agricole is encrypted (SSL-128 bits). The banking information you give, encrypted on your own computer, will never circulate openly on the internet. No credit card number is stored, neither at Léos Créations® nor at its internet host.

Article 5: Shipping, delivery

5.1 Terms of delivery
Delivery times are not contractual. As an indication, delivery is within 48 to 72 hours for France.

5.2 Transfer of the risks
The transfer of the risks on the products takes place as of the handing-over of the products by Léos Créations® to the shipper (insurance cost included). They are insured during the shipping and until the delivery to the recipient, but travel to the risk of the customer.

5.3 Reserves
We recommend that the customer unpacks and checks the merchandise in presence of the shipper in order to report any possible damage. The customer can recant only in the event that the delivery is not in conformity with the order, or in the event of damage. In this case, the delivery form must be annotated and the delivery refused.
Any refusal of delivery must be announced by email or by postal mail to Léos Créations®.

Article 6: Reservation of title
The delivered items remain the property of Léos Créations® until their payment is completed (law N. 80-335 of May 12, 1980)

Article 7 : Time of retraction
In accordance with the provisions of article L.121-16 of the French Consumer Code, the customer has, as of the time of delivery, a period of seven working days to return the products for exchange or refund. In this case, shipping is the responsibility of the customer and he will charge shipping costs. Items must be returned in their original packaging. The items can be replaced or refunded, according to the choice of the customer. Refunding will take place within 30 days. In the event of exchange for one or more items, if the difference in price is in favor of Léos Créations®, it will be charged to the customerÕs credit card, before the new shipping. If the difference in price is in favor of the customer, Léos Créations® will refund the difference within 30 days.

Article 8: Force majeure
Neither Léos Créations® nor the customer can be held responsible for any inexecution of the contract due to a cause beyond control, including but not limited to, war, earthquake, etc.

Article 9: Attribution of competence
In the event of possible dispute on the interpretation or the execution of these conditions and after the failure of any attempt to reach an amiable solution, competence is conferred to the French courts, particularly with those on which Léos Créations® depends.

The entire content (images and text) of the www.leos-creations.com site is the exclusive property of Léos Créations®. You may not reproduce, transmit, publish, plagiarize, modify, archive, retain, display, distribute, or create works derived from this site.
